STAFFBUCKS TERMS OF USE
INTRODUCTION
Please read this web page
carefully. It contains the Terms and Conditions governing your access as a Free
and Paid Member to and use of the Staffbucks Web Site. If you do not accept
these Terms and Conditions or you do not meet or comply with their provisions,
you may not use the Site. If you are an employer or agency using the Site, these
Terms and Conditions, including the Exhibits attached hereto, are part of and
incorporated into your Service Agreement. Since the site uses Yahoo! Groups,
Google Groups and PayPal for mail-list hosting and payment processing, it is
your responsibility to review their Terms of Use as they would be equally
binding along with Staffbucks Terms of Use. These Terms and Conditions are
effective as of Oct 1, 2006.
BINDING AGREEMENT
These Terms of Use, together
with all Exhibits to these Terms and Conditions (as they may be amended from
time to time by Staffbucks) form a binding agreement (the “Agreement”) between
you and Staffbucks. Your access to or use of the Site indicates your acceptance
of these Terms of Use. You are agreeing to use the Site at your own risk.
DEFINITIONS
The following definitions
apply to this Agreement:
a.
"Staffbucks Web Site" or the "Site" includes www.staffbucks.com in its
entirety and its related sites, like www.staffbucks.org owned or operated by
Staffbucks, and includes their Content, Text, Graphics, Design, and Programming
and Services as applicable in the context.
b.
"Content" includes all Text, Graphics, Design and Programming used on the
Site.
c.
“Text" includes all text on every page of the Site, whether editorial,
navigational, or instructional. "Graphics" includes all logos, buttons, and
other graphical elements on the Site, with the exception of paid advertising
banners.
d.
"Design" includes the color combinations and the page layout of the Site.
e.
"Programming" includes both client-side code (HTML, JavaScript, etc.) and
server-side code (PhP, databases, etc.) used on the Site.
f.
"Document" refers to any posting to the Site, whether job or resume.
"Services" means any services provided on the Site by Staffbucks or its agents.
g.
"User" refers to any individual or entity that uses any aspect of the
Site.
h.
"Job Seeker" means a User who is accessing the Site to search for a job
or in any other capacity except as an Employer.
i.
"Employer" means a person or entity that is accessing the Site to post a
job or for any reason related to the purpose of seeking candidates for
employment.
j.
“Agency” or “Recruiting Company” means a person or entity that is
accessing the site to post a job, available candidates or for any reason related
to the purpose of seeking candidates for employment.
k.
"You" and "you" means the person who (or the entity on behalf of whom you
are acting) that is agreeing to these Terms and Conditions.
l.
Staffbucks
offers a unique Rapid Sourcing Model to source technology job requisitions for
permanent and consulting jobs. Reference to “Service” or “Services” in this
agreement shall mean the following services for different type of users:
o
Jobseekers
can Post and Manage profile and Search Jobs & Agencies for Free.
o
Employers
can Post Jobs, Get Job Posting Responses and access Premium Content for small
fees. However Resume Search, Agency Search are currently offered for free.
o
Agencies
can Post Jobs, Get Job Posting Responses and access Premium Content for small
fees. However, Resume Search, Agency Search, Hotlist Posting and Management are
currently offered as free Services.
ACCEPTABLE USE OF SITE
General Use Rules.
The Site is intended for individuals seeking employment and for employers or
agencies seeking candidates for employment. You may use this Site only for
lawful purposes within the stated context of Staffbucks's intended and
acceptable use of the Site. Staffbucks is the sole interpreter of the Site’s
intended and acceptable use.
Your Registration
Obligations:
In
consideration of your use of the Service, you represent that you are of legal
age to form a binding contract and are not a person barred from receiving
services under the laws of the United States or other applicable jurisdiction.
You also agree to: (a) provide true, accurate, current and complete information
about yourself as prompted by the Service's registration form or personnel as
needed and (b) maintain and promptly update the Registration Data to keep it
true, accurate, current and complete if required by contacting Staffbucks. If
you provide any information that is untrue, inaccurate, not current or
incomplete, or Staffbucks has reasonable grounds to suspect that such
information is untrue, inaccurate, not current or incomplete, Staffbucks has the
right to suspend or terminate your account and refuse any and all current or
future use of the Service (or any portion thereof).
License to Use by Users who
are Job Seekers.
Staffbucks hereby grants you a limited, terminable, non-exclusive right to
access and use the Site only for your personal use seeking employment
opportunities for yourself. This authorizes you to view and download a single
copy of the material on the Site solely for your personal, noncommercial use.
You agree that you are solely responsible for the content of any Document
(including resume) you post to the Site and any consequences arising from such
posting. Your use of the Site is a privilege. Staffbucks reserves the right to
suspend or terminate that privilege for any reason at any time, in its sole
discretion.
License to Use by Users who
are employers and agencies.
Staffbucks hereby grants you a limited, terminable, non-exclusive right to
access and use the Site only for your internal business use-seeking candidates
for employment. This authorizes you to view and download a single copy of the
material on the Site solely for your personal use directly related to using the
Site for the purpose of job posting, searching and recruiting job prospects.
Users of the Service please see Definition of “Service” in above clause for
further clarification. You may not sell, transfer or assign any products or
services or your rights to any products or services (including access to the
Services) provided by Staffbucks to any third party without the express written
authorization of Staffbucks. You agree that you are solely responsible for the
content of any Document you post to the Site and any consequences arising from
such posting. Staffbucks reserves the right to suspend or terminate your access
and use at any time if Staffbucks determines that you are in breach of any of
these Terms and Conditions.
Other Specific Rules.
You represent, warrant and agree that you will not use (or plan, encourage or
help others to use) the Site for any purpose or in any manner that is prohibited
by these Terms and Conditions or by applicable law. It is your responsibility to
ensure that your use of the Site complies with these Terms and Conditions and
all applicable laws.
Rules for Posting, Conduct
and Security; You
agree to comply with the "House Rules" for posting, conduct and security on the
Site, which are attached hereto as Exhibit A.
INTELLECTUAL PROPERTY RIGHTS
The Site and all right,
title and interest in and to the Site are the sole property of Staffbucks or its
licensors, and are protected by U.S. copyright and international treaties.
Except for the limited licenses expressly granted to you in these Terms and
Conditions, Staffbucks reserves for itself and its licensors all other right,
title and interest. Without limitation on the foregoing, you may not reproduce,
modify, display, sell, or distribute the Content, or use it in any other way for
public or commercial purpose. This includes copying or adapting the HTML and PHP
code used to generate Web pages on the Site. "Staffbucks," the Staffbucks design
logo and certain other names or logos are service marks or trademarks of
Staffbucks, and all related product and service names, design marks and slogans
are the service marks or trademarks of Staffbucks. In addition, the "look" and
"feel" of the Site (including color combinations, button shapes, layout, design
and all other graphical elements) are also protected by Staffbucks's trademarks,
service marks and copyrights. All other product and service marks contained on
the Site are the trademarks of their respective owners.
You agree to grant to
Staffbucks a non-exclusive, royalty-free, worldwide, perpetual license, with the
right to sub-license, to reproduce, distribute, transmit, create derivative
works of, publicly display and publicly perform any materials and other
information (including, without limitation, ideas contained therein for new or
improved products and services) you submit to any public areas of the Site (such
as bulletin boards, forums and newsgroups) or by e-mail to www.staffbucks.org/www.staffbucks.com
by all means and in any media now known or hereafter developed. You also grant
to www.staffbucks.org/www.staffbucks.com the right to use your name in
connection with the submitted materials and other information as well as in
connection with all advertising, marketing and promotional material related
thereto. You agree that you shall have no recourse against www.staffbucks.org/www.staffbucks.com
for any alleged or actual infringement or misappropriation of any proprietary
right in your communications to Staffbucks.
DISCLAIMERS AND LIMITATIONS
ON STAFFBUCKS LIABILITY.
Allocation of
Responsibility:
Staffbucks assumes no responsibility for Documents posted by Users and no
responsibility for the activities, omissions or other conduct of Users.
Staffbucks acts as a portal for the online distribution and publication of User
submitted information and has no obligation to screen communications or
information in advance and is not responsible for screening or monitoring
Documents posted by Users. If notified by a User of a Document which allegedly
does not conform to this agreement, Staffbucks may investigate the allegation
and determine in good faith and in its sole discretion whether to remove or
request the removal of such Document. Staffbucks has no liability or
responsibility to Users for performance or nonperformance of such activities.
Staffbucks may take any action with respect to User submitted information that
it deems necessary or appropriate, in its sole discretion.
Content
Postings from Members:
You understand
that all information, data, text, software, music, sound, photographs, graphics,
video, messages or other materials ("Content"), whether publicly posted or
privately transmitted, are the sole responsibility of the person from whom such
Content originated. This means that you, and not Staffbucks, are entirely
responsible for all Content that you upload, post, email, transmit or otherwise
make available via the Service. Staffbucks does not control the Content posted
via the Service and, as such, does not guarantee the accuracy, integrity or
quality of such Content. Under no circumstances will Staffbucks be liable in any
way for any Content, including, but not limited to, any errors or omissions in
any Content, or any loss or damage of any kind incurred as a result of the use
of any Content posted, emailed, transmitted or otherwise made available via the
Staffbucks Service. This includes inclusion of resumes
links and content in Staffbucks Newsletters. By posting
any content you agree that any such content can be
included in any Staffbucks Newsletter or other marketing
initiatives. You further agree that by adding your email
address on Staffbucks you will be included in Staffbucks
Newsletter and job postings and you consent to receiving
those.
No endorsements by
Staffbucks:
Nothing on the Site shall be considered an endorsement, representation or
warranty with respect to any User or third party, whether in regards to its web
site, products, services, hiring, experience, employment or recruiting
practices, or otherwise.
No Guaranty of Results:
Staffbucks is not an employment agency or a recruiting firm, and makes no
representations or guarantees regarding the effectiveness or timeliness of the
Site in meeting the employment objectives of Users. Staffbucks does not
guarantee that Documents posted by Users will result in candidates being hired
or job positions being filled, and is not responsible for any employment
decisions, for whatever reason made, made by any User.
DISCLAIMER OF WARRANTY
You expressly
understand and agree that:
o
Your use of the service is at your sole risk. The service is provided on an "as
is" and "as available" basis. Staffbucks and its subsidiaries, affiliates,
officers, employees, agents, partners and licensors expressly disclaim all
warranties of any kind, whether express or implied, including, but not limited
to the implied warranties of merchantability, fitness for a particular purpose
and non-infringement.
o
Staffbucks and its subsidiaries, affiliates, officers, employees, agents,
partners and licensors make no warranty that (i) the service will meet your
requirements; (ii) the service will be uninterrupted, timely, secure or
error-free; (iii) the results that may be obtained from the use of the service
will be accurate or reliable; (iv) the quality of any products, services,
information or other material purchased or obtained by you through the service
will meet your expectations; (v) site and site servers are free of computer
virus and (v) any errors in the software will be corrected.
o
Any material downloaded or otherwise obtained through the use of the service is
accessed at your own discretion and risk, and you will be solely responsible for
any damage to your computer system or loss of data that results from the
download of any such material.
o
No advice or information, whether oral or written, obtained by you from
Staffbucks or through or from the service shall create any warranty not
expressly stated in the Terms of Use.
o
Staffbucks
makes no representations or guarantees regarding the truthfulness, accuracy,
completeness, timeliness or reliability of any Documents posted by Users, or of
any other form of communication engaged in by Users. Documents may contain
inaccuracies or typographical errors. You agree that any reliance on Documents
posted by Users, or on any other form of communication with Users, will be at
your own risk.
o
Staffbucks
makes no representations or guarantees regarding the Content of the Site,
including, but not limited to, broken links, inaccuracies or typographical
errors.
o
A small percentage of users may experience epileptic seizures when exposed to
certain light patterns or backgrounds on a computer screen or while using the
service. Certain conditions may induce previously undetected epileptic symptoms
even in users who have no history of prior seizures or epilepsy. If you, or
anyone in your family, have an epileptic condition, consult your physician prior
to using the service. Immediately discontinue use of the service and consult
your physician if you experience any of the following symptoms while using the
service: dizziness, altered vision, eye or muscle twitches, loss of awareness,
disorientation, any involuntary movement, or convulsions.
DAMAGE LIMITATIONS,
ALLOCATIONS OF LIABILITY AND EQUITABLE RELIEF.
In no event will Staffbucks,
its subsidiaries, affiliates, officers, employees, agents, partners and
licensors shall be liable to you for any direct, indirect, incidental, special,
punitive, consequential or exemplary damages, including, but not limited to,
damages for loss of business profits, business interruption, computer failure,
loss of business information, goodwill, use, data or other intangible losses
(even if Staffbucks has been advised of the possibility of such damages),
resulting from: (i) the use or the inability to use the service; (ii) the cost
of procurement of substitute goods and services resulting from any goods, data,
information or services purchased or obtained or messages received or
transactions entered into through or from the service; (iii) unauthorized access
to or alteration of your transmissions or data; (iv) statements or conduct of
any third party on the service; or (v)
Any Information, or
Transactions provided on the service or
(vi)
Downloaded from the service
or (vii) Any Delay of such Information or Service or (vii)
any other
matter relating to the service.
Staffbucks makes no
representations whatsoever about any other web site, which you may, access
through this one or which may link to this Site. When you access a
non-Staffbucks web site, please understand that it is independent from
Staffbucks, and that Staffbucks has no control over the content on that web
site. In addition, a link to a Staffbucks web site does not mean that Staffbucks
endorses or accepts any responsibility for the content, or the use, of such web
site.
We take all
possible precautions but human errors or any other inappropriate content posting
will not be responsibility of Staffbucks. We also do not have any control on the
number of responses and quality of responses that you get by utilizing our
services. We also do not control any business dealings between members,
responding parties, and organizations marketing their products or candidates
posting their resume. The responsibility of their actions lies with each
individual to determine the viability of the job openings and the suitability of
candidates. You agree that Staffbucks shall not be liable to you or to any third
party for any modification, suspension or discontinuance of the service.
In no event will Staffbucks,
its subsidiaries, affiliates, officers, employees, agents, partners and
licensors shall be liable to you for any liability (described above),
even if Staffbucks or its
authorized representatives have been advised of the possibility of such damages,
or (II) any claim attributable to errors, omissions, or other inaccuracies in
the service and/or materials or information downloaded through the service.
Because some states do not allow the exclusion or limitation of liability for
consequential or incidental damages, the above limitation may not apply to you.
IN SUCH STATES,
your sole and
exclusive remedy for any dispute with Staffbucks, related to these terms of
service shall be cancellation of the services. In the event a court awards
direct damages, despite the foregoing, such damages shall not exceed the lesser
of $0.99 (ninety nine cents) or the amount you paid for the services. In
nutshell, as a subscriber to job posting mail list or as a member posting jobs,
you use our services at your own risk.
PAYMENT,
RENEWAL, SUBSCRIPTION PERIOD & REFUNDS
Subscription Period:
This Agreement shall commence as of the date you
click ”I accept”, agreeing to be bound by the terms of this Agreement (the
”Effective Date”) and shall continue for the duration of the Subscription Period
selected and prepaid in full by You (”Subscription Period”), unless terminated
earlier by Staffbucks as provided herein. You may not cancel this Agreement for
any reason during the Subscription Period.
Refund upon Termination of
Service Agreement:
If at
any time during the course of this Agreement you should terminate a Service
Agreement in which these Terms and Conditions have been incorporated by
reference, not to include your termination in the case of breach of this
Agreement or the Service Agreement by Staffbucks, Staffbucks shall reserve the
right to receive all payments from you for the Services used by you up to
termination and for fifty percent (50%) of the remaining unused portion of the
Service Agreement.
Refunds
if any processed are reduced in value by 50% to cover our payment processing
expenses and personnel costs. Refunds will not be made for postings that have
been approved by the moderators and have been sent out to the Staffbucks list.
Refunds for Per Post, Monthly and Quarterly accounts are not provided.
Automatic Renewal:
For Subscription accounts, unless Staffbucks receives notice from you prior to
the expiration of the current subscription period of your selection of a new
subscription period or your termination of this agreement, following the
expiration of the subscription period, Staffbucks reserves the right to
automatically renew for an additional one (1) renewal period. For each such
Renewal Period, you shall pay to Staffbucks the agreed subscription fee (based
on type of subscription account), and you hereby authorize Staffbucks to
automatically bill your specified credit card for such subscription fee. If
Staffbucks receives a notice of your intent to terminate this Agreement prior to
the expiration of a Renewal Period, this Agreement will terminate on the last
day of that Renewal Period. In the event you select and prepay for a new
Subscription Period at any point during a Renewal Period, this Agreement shall
continue for the duration set forth in Section “Subscription Period” herein
following the expiration of the then-current Renewal Period.
INDEMNIFICATION
You agree to defend,
indemnify, and hold harmless Staffbucks (and its subsidiaries, affiliates,
partners, licensors, officers, directors, employees and agents) from and against
any third party claims, actions or demands (including, without limitation,
costs, damages and reasonable legal and accounting fees) alleging or resulting
from or in connection with your use of the Site, any Document posted by you, or
your breach of this Agreement. Staffbucks shall use reasonable efforts to
provide you prompt notice of any such claim, suit, or proceeding and may assist
you, at your expense, in defending any such claim, suit or proceeding.
PRIVACY POLICY & USER
INFORMATION
The
Privacy Policy posted on the Site is incorporated into this Agreement by
this reference. The
Privacy Policy governs data collected through Staffbucks on-line operations
only. Please note, as set forth in the
Privacy Policy, that Staffbucks may collect certain personal information
from Users and may contact Users periodically in accordance with the terms of
the Privacy Policy. You also consent to such transfer and use of information
with-in United States and to India for storage, processing and use by Staffbucks
and its software development partners. In addition, Staffbucks reserves the
right to comply, in its sole discretion, with legal requirements, requests from
law enforcement agencies or requests from government entities, even to the
extent that such compliance may require disclosure of certain information
collected from Users.
TERMINATION
You agree that
Staffbucks may, under certain circumstances and without prior notice,
immediately terminate your Staffbucks account, any associated email address, and
access to the Service. Cause for such termination shall include, but not be
limited to, (a) breaches or violations of the TOS or other incorporated
agreements or guidelines, (b) requests by law enforcement or other government
agencies, (c) a request by you (self-initiated account deletions), (d)
discontinuance or material modification to the Service (or any part thereof),
(e) unexpected technical or security issues or problems, (f) extended periods of
inactivity, (g) engagement by you in fraudulent or illegal activities, and/or
(h) nonpayment of any fees owed by you in connection with the Services.
Termination of your Staffbucks account includes (a) removal of access to all
offerings within the Service, including but not limited to Staffbucks Posting
form, premium content section, refer friends, Message Boards, and blog (b)
deletion of your password and all related information, files and content
associated with or inside your account (or any part thereof), and (c) barring of
further use of the Service. Further, you agree that all terminations for cause
shall be made in Staffbucks sole discretion and that Staffbucks shall not be
liable to you or any third party for any termination of your account, any
associated email address, or access to the Service.
Either party may terminate
this Agreement without notice at any time for any reason. The provisions of
paragraphs above (Copyright, Licenses and Idea Submissions, Use of the Service,
Indemnification, Third Party Rights and Miscellaneous) shall survive any
termination of this Agreement.
GENERAL INFORMATION
Notice:
Staffbucks
may or may not provide you with notices, including those regarding changes to
the TOS, by email, regular mail or postings on the Service.
Questions and Notices:
Questions
concerning the use of the Site should be directed to
Contact Us. Notices shall be sent, for Staffbucks, to the address listed on
the Site, and, for you, to the address submitted by you or such other address as
Staffbucks reasonably determines is an appropriate address for you.
Links to Other Sites:
Staffbucks contains
links to third party web sites. These links are provided solely as a convenience
to you and not as an endorsement by Staffbucks of the contents on such
third-party web sites. Staffbucks is not responsible for the content of linked
third-party sites and does not make any representations regarding the content or
accuracy of materials on such third-party web sites. If you decide to access
linked third-party web sites, you do so at your own risk.
Amendments to this Agreement
and Changes to Site:
Staffbucks may revise this
Agreement at any time by updating this page. Changes will be binding on you on
the date they are posted on the Site (or as otherwise stated in the any notice
of such changes). Any use of the Site will be considered acceptance by you of
the then-current Terms and Conditions (including any Exhibits thereto). If at
any time you find the Terms and Conditions unacceptable, you may not use the
Site any longer. Any new or different terms supplied by you are specifically
rejected by Staffbucks unless Staffbucks agrees to them in a signed writing
specifically including those new or different terms. Staffbucks may change the
Site at any time.
Entire
Agreement:
The Terms of
Use constitutes the entire agreement between you and Staffbucks and governs your
use of the Service, superseding any prior agreements between you and Staffbucks
with respect to the Service. You also may be subject to additional terms and
conditions that may apply when you use or purchase certain other Staffbucks
services.
Choice of Law and Forum: The Terms of Use and the relationship between
you and Staffbucks shall be governed by the laws of the State of California
without regard to its conflict of law provisions. You and Staffbucks agree to
submit to the personal and exclusive jurisdiction of the courts located within
the county of Orange, California.
Waiver and
Severability of Terms:
The failure of
Staffbucks to exercise or enforce any right or provision of the Terms of Use
shall not constitute a waiver of such right or provision. If any provision of
the Terms of Use is found by a court of competent jurisdiction to be invalid,
the parties nevertheless agree that the court should endeavor to give effect to
the parties' intentions as reflected in the provision, and the other provisions
of the Terms of Use remain in full force and effect.
All provisions of this
Agreement shall survive termination except those granting access or use to the
Site, and you shall cease all your use and access thereof immediately.
You may not
assign this Agreement or any of your rights hereunder. Any such attempted
assignment shall be null and void.
No waiver of any
term of this Agreement shall be deemed a further or continuing waiver of such
term or any other term. Except as expressly provided by Staffbucks in a
particular "Legal Notice," or software license or material on particular Web
pages of the Site, this Agreement and your Service Agreement where applicable,
constitute the entire agreement between you and Staffbucks.
Statute of
Limitations:
You agree that
regardless of any statute or law to the contrary, any claim or cause of action
arising out of or related to use of the Service or the Terms of Use must be
filed within one year after such claim or cause of action arose or be forever
barred.
Exhibit A -House Rules
regarding Posting, Conduct and Security
Staffbucks is the sole
interpreter of these rules. Users who violate these rules may have their access
and use of the Site suspended or terminated, at Staffbucks's discretion.
Staffbucks reserves the right to change these rules in accordance with the
amendment policy in the Terms and Conditions to which this Exhibit A is
attached.
Posting Rules:
a.
Your Documents and postings may not contain:
o
URLs or links
to Web sites (to advertise your company or Web site, see our
Advertising Info page.);
o
copyrighted
material (unless you own the copyright or have the owner's permission to post
the copyrighted material);
o
trade secrets
(unless you own them or have the owner's permission to post them);
o
material that
infringes on or misappropriates any other intellectual property rights, or
violates the privacy or publicity rights of others;
o
keywords or
white text keywords (including any words embedded in the Document and hidden
from the User);
o
anything that
is sexually explicit, obscene, libelous, defamatory, threatening, harassing,
abusive, or hateful; or
o
anything that
is embarrassing or offensive to another person or entity.
b.
You may not use your Document(s) and postings to to:
o
impersonate
another person, living or dead;
o
post false,
inaccurate or misleading information;
o
"stalk" or otherwise harass another; and/or
o
post
advertisements or solicitations of business (including, but not limited to,
Email Processors, Project 21, franchises, "club memberships," distributorships,
or anything requiring a monetary investment by the User, including a request for
payment to obtain job listings);
o
post chain
letters, spam or pyramid schemes or any other form of solicitation; or
o
post opinions
or notices, commercial or otherwise.
c.
Your Document(s) must contain sufficient detail to convey clearly to the
User the nature and requirements of the job opportunity, or your qualifications
as a candidate for employment. Documents that encourage the User to "email for
more details" are not permitted. Documents from any third party charging a fee
or restricting complete access to all resume information are prohibited.
d.
Job postings must be individual openings for traditional, W-2, Corp2Corp,
or 1099 employees.
e.
Resume and Candidate Profile postings must contain the accurate resume of
a living individual seeking employment on a full-time, part-time, or contractual
basis on his or her own behalf.
f.
General practices regarding use and storage: You acknowledge that Staffbucks may
establish general practices and limits concerning use of the Service, including
without limitation the maximum number of days that job posting messages, message
board postings or other uploaded Content will be retained by the Service, the
maximum number of email messages that may be sent from or received by an account
on the Service, the maximum size of any email message that may be sent from or
received by an account on the Service, the maximum disk space that will be
allotted on Staffbucks servers on your behalf, and the maximum number of times
(and the maximum duration for which) you may access the Service in a given
period of time. You agree that Staffbucks has no responsibility or liability for
the deletion or failure to store any messages and other communications or other
Content maintained or transmitted by the Service. You acknowledge that
Staffbucks reserves the right to log off accounts that are inactive for an
extended period of time. You further acknowledge that Staffbucks reserves the
right to modify these general practices and limits from time to time.
g.
Staffbucks is under no obligation to monitor the Documents posted on the
Site, but it may monitor Documents at random. Documents found to violate the
above Posting Rules may be removed at Staffbucks discretion.
Conduct Rules:
As a user, you
are responsible for your own communications and are responsible for the
consequences of their posting. You acknowledge that any reliance on material
posted by other users will be at your own risk.
a.
You may not respond to postings by other Users in any manner or for any
purpose other than that which is expected (i.e., to apply for the job or to
initiate further discussion with the candidate). Communications soliciting the
employer's business by our competitors are prohibited.
b.
You may not send unsolicited commercial email to Users.
c.
Protect your password. You are responsible for maintaining the
confidentiality of your information and password. You are responsible for all
uses of your registration, whether or not authorized by you. If others use your
password to post inappropriate material on the Site, you risk losing your access
to the Site. You agree to notify Staffbucks immediately of any unauthorized use
of your registration and password.

You may not delete or revise any material posted by any other person or
entity.
f.
If at any time
during the term of this agreement Staffbucks comes to the understanding that
you: (i) misled Staffbucks of your business practices and/or services, or (ii)
purchased services that do not represent your precise business, Staffbucks
reserves the right to terminate this agreement.
g.
Staffbucks is
under no obligation to monitor the conduct of its Users, but it may investigate
and respond when violations are reported.
h.
provide
any negative feedbacks on Staffbucks Service or attempt to defame any other
organizations by using our service.
i.
collect or store personal data about other users in connection with the
prohibited conduct and activities set forth in paragraphs above.
j.
Post empty emails from the Mail List form and observe every precaution towards
responsible usage of the email list.
k.
Email list Members should not collect and harvest email addresses which get
disclosed as a result of use of Staffbucks service for personal mailings. Even
though members (those who post as well as those who receive jobs) use our
services at their own risk, we would like to remind that this is not an
advisable practice and only you would be responsible for your actions and held
liable.
l.
Staffbucks may invite members to join our job-posting list from time to
time. Members join at their own will and leave at their own will. Any members
joining must understand how to leave and it is their responsibility to review
the FAQ and Yahoo Forum's FAQ sections to understand how the service works.
Security Rules:
Users are prohibited from
violating or attempting to violate the security of the Site, including, without
limitation:
a.
Accessing data not intended for such User or logging into a server or
account which the User is not authorized to access;
b.
attempting to probe, scan or test the vulnerability of a system or
network or to breach security or authentication measures without proper
authorization;
c.
attempting to interfere with service to any User, host or network,
including, without limitation, via means of submitting a virus to the Site,
overloading, "flooding", "mailbombing" or "crashing";
d.
sending unsolicited e-mail, including promotions and/or advertising of
products or services;
e.
forging any TCP/IP packet header or any part of the header information in
any e-mail or newsgroup posting. Violations of system or network security may
result in civil or criminal liability.
f.
Interfering
with or disrupting service or servers or networks connected to the Service, or
disobey any requirements, procedures, policies or regulations of networks
connected to the Service.
g.
Intentionally or unintentionally violate any applicable local, state,
national or international law.
h.
provide material support or resources (or to conceal or disguise the nature,
location, source, or ownership of material support or resources) to any
organization(s) designated by the United States government as a foreign
terrorist organization pursuant to section 219 of the Immigration and
Nationality Act;
i.
Violation of these Security Rules may result in civil or criminal
liability. Staffbucks will investigate occurrences, which may involve such
violations and may involve, and cooperate with, law enforcement authorities in
prosecuting Users who are involved in such violations.
